Haitian refugee wins

U.S. asylum -- for now

The Board of Immigration Appeals on Wednesday granted a last-minute stay of
deportation to one of the 16 still-detained asylum-seekers from a Haitian
refugee boat that carried more than 200 into Biscayne Bay on Oct. 29.

Rochenel Charles, 55, won asylum in February in immigration court, but the
Department of Homeland Security appealed and kept him detained. The board
ruled in the government's favor but agreed to reconsider following a motion
from Charles' attorney, Candace Jean, involving new evidence and a new legal
argument.

Jean, of Catholic Charities, said Charles was at the airport in a wheelchair
when he heard of Wednesday's decision and returned to Krome.
