Haitian groups to refile lawsuit over offensive video game

Haitian civil rights groups have withdrawn a federal lawsuit against a
top-selling video game they claim is racist and violent but plan to refile
the suit in state court by next week, the groups' lawyer, Barry Silver, said
Monday.

Silver said he wanted to argue the case under Florida law because there it
has more restrictions on freedom of speech than federal law. The case was
originally filed in state court last month, but attorneys for Rockstar Games
Inc., the company that manufactures Grand Theft Auto: Vice City, were
allowed to move the case to federal court.

The game takes place in a fictional Miami and encourages players to "kill
the Haitians" and "kill the Cubans." The suit names Target Corp., Wal-mart
Stores, Best Buy Co. and Sony Computer Entertainment. Rockstar Games has
apologized for any offense and said objectionable content will be removed
