In a Second Unanimous Decision, Haiti's Supreme Court Reconfirms the Constitutionality of the Siméus Reform Campaign, Invalidates Recent Actions by the 'Commission on Nationality'

December 7, 2005 (PORT-AU-PRINCE) The Supreme Court of Haiti -- the only constitutional authority in a country whose interim government is overwhelmed by violence, poverty, chaos and corruption -- today issued a second unanimous ruling reinstating the reform presidential campaign of pro-democracy candidate Dumarsais Siméus and legally requiring that his candidacy be placed back on the Presidential ballot.

Hailing the decision as "the final victory for democracy, rule of law and clean government," Siméus said, "This is not about Dumarsais Siméus.  It is about the right of every Haitian to have a voice in their future, to choose their next leader.  It is a right too many people in Haiti have never known."

Today's decision also invalidates the "Commission on Nationality" formed in October by Prime Minister Gerard LaTortue, after the first Supreme Court decision confirming the constitutionality of the Siméus pro-democracy reform campaign.  This Commission removed the Siméus candidacy and one other from the Haitian Presidential ballot, while allowing convicted criminals and others who did not meet the Constitutional requirements to run for President.

The Artibonite-born reformer has had to the battle against a series of election abuses by powerful government insiders, who employed a string of back-door tricks in an attempt to exclude the formidable reformer from the ballot, including actions by government and the electoral council to:

* Attempt to deny the Haitian nationality that belongs to Siméus by birth;
* Ignore electoral laws requiring the CEP to file objections within 72 hours;
* Falsify and forge documents which are clearly not in his handwriting;
* Use police powers of the state to "find" immigration cards;
* Intervene outside the Prime Minister's constitutional authority to block Siméus;
* Register others holding French and U.S. passports while blocking Siméus;
* Even "losing" and then "finding" the candidate's CEP registration files.
		* Ignore the Supreme Court ruling and illegally remove the candidate from the
		  final Presidential ballot

 "This is a victory for the Haitian people, who have suffered for too long under the oppression of the same little group of politicians who perpetuate a failed political system, broken economy and violence in our streets, while people in the world outside have healthy food to eat, clean water to drink, good jobs to work, safe streets to enjoy, and free societies that respects the right of every citizen to earn a better life," said the pro-democracy reformer.

"Every Haitian has been presented with new rights today by the highest legal authority in the country -- the right to freely choose their next leader.  With the support of my Haitian brothers and sisters, we will move forward to bring a bold new vision of unity, prosperity and success for every mother and father and every native son and daughter," continued Siméus, "so that tomorrow can be even better than today."

The presidential campaign of Dumarsais Siméus is the result of a draft movement which began last spring, as delegations of key Haitian business, civic and charitable leaders called on the global businessman, asking him to consider running for President and leading the land of his birth in a bold new direction.

During his campaign he accepted the nomination of Tet Ansanm "All Together" party, a broad based pro-democracy reform coalition with 30 Senatorial candidates and 99 candidates for Deputy in the Haitian Congress.  Fully 100% of local cartel elections (similar to City Councils in the United States) include candidates nominated by Tet Ansanm alliance.  With the momentum of today's Supreme Court victory, Dumarsais Siméus and the Tet Ansanm coalition will continue to reach out to more political parties, political leaders and others in the coming weeks.
