"The U.S. attorney's office said in a statement that the agreement "accurately reflects the totality of the circumstances."

IMHO, this was a federal prosecutor looking to embellish his convictions track record IN THE ABSENCE OF CRIMINAL INTENT.  I'd say  the "Totality of the circumstances" were ignored rather than considered.
